INTRODUCTION

The Personal Information Protection Act (the “Act”) is the provincial legislation that regulates how private sector organizations in Alberta collect, use and disclose personal information. The Act defines that personal information includes any information that can be used to identify an individual. Fit Law LLP acknowledges that in the course of our legal practice we have an ethical and legal obligation to protect the personal information that is received by us. It is our policy to uphold this obligation in accordance with the Act and where applicable, the provisions of the Personal Information and Electronic Documents Act.

COLLECTION, USE AND DISCLOSURE

According to the Act you are deemed to consent to the collection, use or disclosure of personal information about yourself for a particular purpose if you voluntarily provide the information for that purpose, and it is reasonable that you would voluntarily provide that information. 

By retaining Fit Law LLP for legal advice, we consider that you consent to our collection, use or disclosure of your personal information as is necessary to properly advise and represent you. Further, depending on the context, we will rely on this deemed consent when there is a pre-existing client relationship, your express consent has been previously given, or the purpose of using the personal information is reasonably clear to you.

REQUESTS FOR ACCESS TO PERSONAL INFORMATION 

You have the right to request access to your personal information that is in the custody and control of Fit Law LLP. Such request must be in writing and provide Fit Law LLP with enough detail to enable us to identify what records contain the personal information you are requesting access to.

Fit Law LLP will make reasonable efforts to assist you in your request. 

Access to personal information is not guaranteed as there are exceptions as provided in the Act where Fit Law LLP is not required to provide you with access, for example where disclosure would reveal personal information about another individual. In the event access is not provided, reasons will be provided to you.

Fit Law LLP may charge you a reasonable fee for fulfilling a request for access to personal information.

REQUESTS FOR CORRECTION TO PERSONAL INFORMATION 

You have the right to request correction to your personal information that is in the custody and control of Fit Law LLP. Such requests must be in writing and provide Fit Law LLP with enough detail to enable us to identify what records contain the personal information you are requesting correction to.

Fit Law LLP is entitled to determine whether a correction is required. In the event we determine a correction is required, we will do so as soon as reasonably possible and notify any other organization to whom we have provided the incorrect information. 

PROTECTION AND RETENTION OF PERSONAL INFORMATION  

We acknowledge the requirements of the Act on us to protect your personal information and as such have made reasonable arrangements to secure against the risks of its unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction.

The Act allows us to retain your personal information as long as is reasonable for legal and business purposes. After this time has passed, we will destroy your personal information or otherwise render it void of any identifying information. 

WEBSITE AND FURTHER USE

When you visit and otherwise use our website, you do so voluntarily and are deemed to consent to our collection of your personal information through your use of our website.

Fit Law LLP may use personal information as required for the purpose of improving our services to you, including for marketing strategies and business development. In such circumstances, we will not disclose any identifying information without notifying you and requesting prior consent from you.
